Public Offer Agreement for Funeral Services Provided by Ascension Funeral Bureau
This document is an official public offer, hereinafter the Offer Agreement, of Ascension Funeral Bureau, hereinafter the Contractor, addressed to an indefinite number of individuals and legal entities, hereinafter the Customer. This public agreement is concluded through the Customer’s full and unconditional acceptance of all terms set out below in accordance with Article 633 of the Civil Code of Ukraine.
Acceptance of this Agreement includes placing an order, signing an order form or invoice, making a partial or full payment, or taking any other clear action that confirms the intention to receive the Contractor’s funeral services. Before acceptance, the Customer shall independently review the terms of this document.
1. Terms and Definitions
- Offer Agreement — this public agreement published on the Contractor’s official website at https://kpbr.com.ua/, which defines the terms of cooperation between the Contractor and the Customer.
- Contractor — Ascension Funeral Bureau, which arranges and provides funeral services, related goods, paperwork support, and consultations.
- Customer — any individual or legal entity that contacts the Contractor to arrange a burial, cremation, or another service and accepts the terms of this Agreement.
- Funeral services — the full scope of services related to burial arrangements, cremation, transportation of the deceased including Cargo 200, exhumation, morgue services, embalming, ceremonial transport, memorial and funeral rites, remembrance events, and the supply of funeral goods.
- Acceptance — the Customer’s full and unconditional acceptance of the terms of this Agreement, confirmed by actions indicating an order or payment for the Contractor’s services.
2. Subject of the Agreement
2.1. The Contractor undertakes to provide the Customer with funeral services according to the selected scope, including packages such as Economy, Standard, VIP, or an individual arrangement, and the Customer undertakes to accept and pay for those services.
2.2. The list of works, goods, timing, venue of the ceremony, and the agreed cost are specified in the order invoice or order form, which forms an integral part of this Agreement.
3. Procedure for Concluding the Agreement
3.1. The Agreement is deemed concluded from the moment the Customer accepts it, including by signing the order invoice, making a payment, or giving consent to the Contractor’s funeral agent to begin arranging the process.
3.2. By placing an order, the Customer confirms that they have reviewed this Agreement, the current price list, and other service terms, understand their content, and fully agree with them.
4. Service Price and Settlement Procedure
4.1. The price of services is determined on the basis of the Contractor’s current tariffs, price lists, and rates valid at the time of ordering. Information about package solutions is for reference only and is finalized in the order invoice.
4.2. Payment shall be made by the Customer in the national currency of Ukraine in cash, by bank card through a payment terminal, or by bank transfer to the Contractor’s account details.
4.3. Unless otherwise agreed in writing by the parties, funeral services and related goods are provided on the basis of 100% prepayment or an agreed partial prepayment recorded in the order invoice.
5. Rights and Obligations of the Parties
5.1. The Contractor shall:
- Provide the agreed funeral services properly, on time, and in full accordance with the order.
- Ensure consultation and support from a funeral agent at every stage of the farewell arrangements.
- At the Customer’s request, assist in obtaining the necessary documents, including medical certificates, the state death certificate, and documents for social assistance.
- Arrange transportation of the body, morgue services, body preparation, a hearse, pallbearers, and other agreed elements of the ceremony.
- Provide funeral accessories, coffins, wreaths, crosses, textiles, and other goods according to the approved order.
5.2. The Customer shall:
- Provide the Contractor with complete, accurate, and reliable information as well as the documents necessary to arrange the services.
- Pay for the ordered services and goods in full and on time in the agreed amount and manner.
- Ensure access for the Contractor’s staff to the location of the body when required for transportation or preparatory work.
- Immediately inform the Contractor of any changes to the agreed circumstances, date, venue, or other material terms of the order.
6. Procedure for Providing and Accepting Services
6.1. Services are provided after all organizational details have been agreed with the funeral agent, the order has been completed, and this Agreement has been accepted by the Customer.
6.2. Proper provision of services is confirmed by the completion of the agreed arrangements, transfer of the service result to the Customer, signing of the relevant documents, or the absence of substantiated written claims after the burial, cremation, or another ceremony has been completed.
7. Liability of the Parties and Force Majeure
7.1. For non-performance or improper performance of the terms of this public agreement, the parties shall bear liability in accordance with the applicable legislation of Ukraine and the terms of the executed order.
7.2. The parties shall be released from liability for breach of obligations if such breach results from force majeure circumstances, including war, natural disasters, quarantine restrictions, decisions of public authorities, or other events that the parties could neither foresee nor prevent.
8. Dispute Resolution
8.1. All disputes and disagreements between the Customer and the Contractor shall first be settled through negotiations and written communications.
8.2. If no agreement is reached, the dispute shall be resolved by a court in accordance with the applicable legislation of Ukraine.
9. Term of the Agreement
9.1. This Offer Agreement enters into force upon the Customer’s acceptance and remains valid until the parties fully perform their obligations.
10. Other Terms
10.1. By accepting this Agreement, the Customer consents to the processing of their personal data and the personal data of the deceased solely for the purpose of proper performance of the Agreement, document processing, ceremony organization, and accounting support.
10.2. The Contractor undertakes to ensure the confidentiality of the information received and to use it only to the extent necessary for fulfilling obligations to the Customer and complying with legal requirements.
